Website and Portal Terms of Use
These Terms of Use govern your access to and use of the Carbynix website and customer portal (the "Sites"). By using the Sites you agree to these Terms. If you purchase or use the Carbynix Services, the Master Services Agreement and the documents it incorporates also apply, and they control for the Services.
1. Accounts
You are responsible for your account credentials and for activity under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it current.
2. Acceptable use of the Sites
Do not misuse the Sites: no unlawful use, no attempts to gain unauthorized access, no interference with operation or security, no scraping or automated access except as permitted, and no use that infringes others' rights. The Acceptable Use Policy also applies to the Services.
3. Intellectual property
The Sites and their content, other than your own data, are owned by Carbynix or its licensors and are protected by law. We grant you a limited, revocable, non-transferable right to use the Sites for their intended purpose. Carbynix trademarks and brand may not be used without permission.
4. Third-party links and content
The Sites may link to third-party sites or services that Carbynix does not control and is not responsible for.
5. Disclaimers and limitation of liability
The Sites are provided "as is." To the extent permitted by law, Carbynix disclaims all warranties regarding the Sites and is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Sites. For any direct damages relating to the Sites, Carbynix's total liability is limited to one hundred US dollars (US$100). If you are a Carbynix customer, the limitation of liability in the Master Services Agreement governs your use of the Services.
6. Privacy
Your use of the Sites is also governed by the Carbynix Privacy Policy.
7. Changes and governing law
We may update these Terms; the current version applies. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Venue and dispute resolution are as set out in the Master Services Agreement, section 18, which applies to any dispute relating to the Sites or the Services.
